Family Jr.’s “Kapowerful” CONTEST (the Contest”)
OFFICIAL RULES (the “Contest Rules”)

CONTEST PERIOD:
The Contest runs from 10:00 a.m. Eastern Time (“ET”) Monday May 14, 2018 to 10:00 a.m. ET June 4, 2018 (the “Contest Period”).

HOW TO ENTER
NO PURCHASE NECESSARY.

To enter the Contest:

1) Watch episodes of Kody Kapow on Family Jr.’s channel, during the Contest Period, every weekday, starting Monday, May 14, 2018 at 7:40 a.m. ET and 7:00 p.m. ET, as well as every Sunday at 7:00 p.m. ET. Check your local television listings to see when Kody Kapow is airing in your local time zone.
                       
OR;

2) Visit www.FamilyJr.ca (the “Website”) during the Contest Period and watch an episode of Kody Kapow by going to the “Videos” page starting Monday, May 14, 2018.  A new episode will be released every Monday during the Contest Period.

Once you have obtained the answers to the multiple choice trivia questions by watching episodes of Kody Kapow, go to the Website and click on the "Kapowerful Contest" icon displayed in the “Contests” section of the Website to access the Contest microsite.  Click the ENTER button to access the standard Contest entry form. Fill out the entry form by (i) correctly answering the five multiple choice questions about Kody Kapow; (ii) entering your full name, city, province or territory, phone number and email address and parent or legal guardian’s full name and contact information if you are a Minor entrant (as defined in Eligibility); and (iii) then submit your completed entry form with correct answers to the multiple choice trivia questions. A completed online entry form will constitute one entry into the Contest.

The only method of entry for this Contest is online entry (internet access required). Online entry is available through the Website only; no other means of submission will be accepted. Although online access and an email account are required in order to participate, no purchase is required in order to enter the Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.

All eligible Contest entries will be entered for a chance to win the Grand Prize.

ELIGIBILITY
The Contest is open only to permanent lawful residents of Canada, excluding: (i) residents of Quebec under 13 years of age; (ii) any person, or any person whose immediate family members (i.e., parents, children, spouse, siblings, grandparents, the “steps” of each and persons residing in such immediate family members' household), and persons with whom they are domiciled, has been declared a winner of another contest sponsored by DHX Television Ltd. (“Family Jr.”), or Transat Canada Inc. (Family Jr., and Transat Canada Inc. together are the “Contest Sponsors”) within 90 days of the start of the Contest Period; and (iii) employees, officers, directors, representatives, and agents (and their immediate family members, or persons with whom they are domiciled) of the Contest Sponsors. This Contest is subject to all federal, provincial, and municipal laws and regulations. Void where prohibited by law. Contest Sponsors, with the consent of the Régie des alcools, des courses et des jeux (the “RACJ”), reserve the right to cancel or suspend this Contest in the event of any accident, or administrative or other error of any kind.

An entrant under the age of majority in his/her province of residence (a “Minor”) must have a parent or legal guardian consent to his/her participation.  Minor entrant’s parent or legal guardian must provide his/her email address on the entry form, or the entry form will be disqualified Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, or if satisfactory proof of identification to confirm the winner’s (or the Minor winner’s parent or legal guardian’s) identity and personal information provided in connection with the Contest, including but not limited to, the winner’s (or the Minor winner’s parent or legal guardian’s) name and email address, cannot be obtained, the entry will be disqualified.

Entries must be received no later than 10:00 a.m. ET on June 4, 2018. Contest Sponsors take no responsibility for entries that are lost, misdirected, delayed, garbled, incorrect, illegible or received after the Contest deadline.

Limit one entry per person, per dayin addition to a limit of four entries from the same household per day.
Only one email address and account may be used by any person to enter the Contest. In the event that the Contest Sponsors receive more than the permitted number of entries, Contest Sponsors reserve the right to void and destroy any entries from that entrant and household, and that entrant/household may, at the discretion of the Contest Sponsors, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. Contest Sponsors reserve the right to disqualify all such entrants from future contests conducted by the Contest Sponsors without further notice.

In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be deemed to be made by the authorized account holder of the email address at the time of entry. The authorized account holder is the natural person who is assigned an email address by an Internet service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.

PRIZES
(referred to herein as “Prize(s)”, “Grand Prize(s)” as applicable)

GRAND PRIZE
There is one Grand Prize package available to be won, consisting of:

  • One 7 night all-inclusive package for two adults, and two kids, ages 12 and under,    staying at the Hard Rock Hotel Riviera Maya, in one Deluxe Gold King (Gardenview room) (one room, based on quad occupancy) (approximate retail value $5,000.00);
  • Roundtrip economy airfare for two adults, and two kids, from nearest Canadian airport to the winners' home servicing Air Transat flights to Cancun, Mexico (approximate retail value $2,200.00); and
  • Ground transfers for two adults, and two kids, from the Cancun airport to the hotel (approximate retail value $300.00).  

Approximate retail value of the Grand Prize package is $7,500.00, but may vary depending on dates of travel, and the departure city.  All amounts are in Canadian dollars. 

WINNER SELECTION
A random draw will be held at 12:00 p.m ET on June 4, 2018 at Family Jr.’s office located at 207 Queens Quay West, Suite 550, Toronto, Ontario. There will be one Grand Prize draw to fulfill this Contest. The chances of being selected to win a Prize in this Contest depend on the total number of eligible entries received.

GRAND PRIZE TRIP CONDITIONS:
By accepting the Grand Prize, winner (or a Minor entrant’s parent/legal guardian on his/her behalf), agree to travel between June 15, 2018 and May 15, 2019 (the “Travel Period”).  Travel must be booked by January 15, 2019.  The following standard blackout dates apply: 1) Christmas and New Year: from December 16, 2018 to January 6, 2019; 2) Spring Break: from February 18, 2019 to March 24, 2019; and 3) Easter: from April 12, 2019 to April 22, 2019. Entrants selected as the Grand Prize winner, and his/her guest(s), must be able to travel during the Travel Period or the selected Grand Prize winner and his/her guests shall forfeit the Grand Prize. All travel is booked on behalf of the Grand Prize winner and his/her guests by the Contest Sponsors or its representative and is based on availability.

The Grand Prize winner and his/her guests will be responsible for obtaining any required travel, health and identification documents (which must be valid prior to and for the entire duration of the trip). Visit the Passport Canada website for detailed information on the new mandatory passport requirements http://www.passportcanada.gc.ca/. The Grand Prize winner and his/her guests are solely responsible for determining and obtaining all necessary travel documents, identification, and other travel requirements. The Releasees (as defined under the “Acceptance of Prize” section below) shall not be responsible for any winner, and/or his/her guests, in the event they are denied entry to a foreign country, re-entry to Canada, by customs officials of either country, and/or do not have the required travel documentation and identification, and in such event, the Contest Sponsors will not provide any compensation, or additional travel or accommodation the winner and his/her guests and the unused portion(s) of Grand Prize shall be forfeited.

All costs and expenses not specifically included above as part of each Grand Prize including, without limitation, taxes, fees, gratuities, travel insurance, items of a personal nature, additional optional excursions, tours, parking, souvenirs, and merchandise (“Expenses”), are the sole responsibility of the Grand Prize winner and his/her guests. The Grand Prize winner and guests may not seek reimbursement for any Expenses from the Releasees (as defined under the “Acceptance of Prize” section below). 

Lost or stolen tickets and travel vouchers will not be replaced.  It is strongly recommended that the declared winner and his/her traveling companion(s) purchase medical, accident and baggage insurance. The Contest Sponsors are not responsible in this respect. It is the responsibility of the declared winner and his/her guests to check with the airline for baggage restrictions.

The Grand Prize Winner and his/her three guests must travel together on the same itinerary. No changes will be made to travel details once any portion of travel arrangements has been made, except as may be required due to availability and/or as may be required by the Contest Sponsors in their sole and absolute discretion. The Grand Prize (and all elements thereof) is not redeemable for cash and is non-transferable except in the Contest Sponsors sole and absolute discretion. The Grand Prize may not be sold or transferred to any other person or third party.

Actual retail value of the Grand Prize vacation package may be higher or lower based on departure schedules and locations and seasonal rates.  If the actual value of the Grand Prize is less than the stated ARV, the difference will not be awarded.

If the Grand Prize winner is under 18 years of age, at the date of departure, one of the Grand Prize winner’s guests must be his/her parent or legal guardian, who has agreed to be fully and legally responsible for the Grand Prize winner and any other guests under 18 years of age at the date of departure (the “Minor Guest(s)”), for the duration of the Grand Prize trip, including sharing the same hotel room.

Each of the Grand Prize winner’s Minor Guest(s), must either (i) travel with his/her parent or legal guardian who shall be one of winner’s guests and who shall be fully and legally responsible for the Minor Guest for the duration of the Grand Prize trip; and must stay in the same room as his/her parent or legal guardian; or (ii) if the Minor Guest is not traveling with his/her parent or legal guardian, the Minor Guest must stay in the same room with winner who is 18 years of age, or older, or with the Minor winner’s parent or legal guardian, in which case the Minor Guest’s parent or legal guardian must in advance appoint the winner, or Minor winner’s parent or legal guardian (as applicable) full legal custody and control over the Minor Guest and the ability to contract on his/her behalf for the duration of  the Grand Prize trip.  Each Minor Guest must meet the foregoing conditions in order for the Minor Guest to be eligible to accompany the winner on the Grand Prize trip.

ACCEPTANCE OF PRIZE
A Family Jr. representative will notify the selected entrant, or the parent/legal guardian of the selected entrant who is a Minor, by telephone or email within two days of the draw. Each selected entrant will then have within 7 days, following receipt of notification to contact Family Jr. and provide requested documentation to claim his/her Prize. Notification shall be deemed to have occurred, in the case of telephone notification, on the date that selected entrant, or in the case of a Minor, his or her parent or guardian, speaks with a representative of Family Jr., or, in the case of email notification, the date the email is sent to the selected entrant’s email address by Family Jr., or in the case of a Minor, his or her parent or guardian. It is the responsibility of the selected entrant or the selected Minor entrant’s parent/legal guardian to check his or her email account in a timely manner. Prior to being awarded a Prize, each entrant selected as a winner must correctly complete, unaided, a time-limited, mathematical, skill testing question and must sign a declaration and release form (the “Declaration and Release”) confirming compliance with these Contest Rules, his/her acceptance of the Prize as awarded; and acknowledging the non-responsibility of the Contest Sponsors, each of their parents, affiliates, subsidiaries, cable and satellite affiliates, associates, their respective promotional and advertising agencies, and each of their respective employees, officers, directors, agents, successors and assigns (the “Releasees”), with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the Contest, any Prize awarded, the acceptance, use, misuse, possession and delivery of a Prize, participation of winner and his or her guests in any Prize related activities, printing errors or claims based upon publicity rights, defamation or invasion of privacy. A Minor winner’s parent or legal guardian must sign the Declaration and Release on his/her behalf in order for the winner to claim his/her Prize.

Each of the winner’s guests must sign a release form similar to the winner’s Declaration and Release in order to be eligible to participate in the Grand Prize.

The Declaration and Release must be signed and returned within seven days from the date it was sent by Family Jr. Should Family Jr. be unable to contact the selected entrant by telephone or email, or should a selected entrantbe unable to correctly answer the skill-testing question or does not respond and complete the Declaration and Release by the deadline specified above, that selected entrant will be deemed to have forfeited any rights to the Prize and an alternate entrant will be selected in the same manner, by random draw taken from the same pool of entries, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry. This process shall be repeated until such time as a selected entrant is confirmed to be a Prize winner or until there are no more eligible entries, but in any event no later than June 30, 2018. All Prize taxes, if any, are the responsibility of each winner. Limit one Prize per household.

Contest Sponsors will not be held responsible for the loss of any Prize due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or email address.

Family Jr. or its appointed designee shall deliver Prizes to selected winner(s).

GENERAL CONDITIONS
By submitting an entry, each entrant (or Minor entrant’s parent or legal guardian on his/her behalf) agrees to be bound by these Contest Rules.
 
All entries become the property of Family Jr. and will not be returned.

Each Prize must be accepted “as is” and may not be exactly as shown. Contest Sponsors, in their sole discretion, reserves the right to substitute any portion of a Prize with a prize of equivalent or greater retail value.  Some restrictions may apply. Prizes are non-transferable, non-refundable, non-negotiable and have no cash value. If the actual value of any Prize is less than the stated approximate retail value, the difference will not be awarded.  All Prize elements are subject to availability.

All incidental costs and expenses, including but not limited to, transportation to/from the departure airports, parking, additional excursions, gratuities, travel insurance, and souvenirs (the “Expenses”) not specifically mentioned herein as part of the Prize description are the sole responsibility of the Prize winner. The Prize winner shall not seek reimbursement for the Expenses from the Contest Sponsors.

Except where prohibited by law, Contest Sponsors do not make any representation nor offer any warranty, express or implied, as to the quality or fitness of the Prize(s) awarded in connection with the Contest. Each Prize winner (or parent/legal guardian of a Minor winner) understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsors should the Prize fail to be fit for any purpose or is in any way unsatisfactory to a Prize winner.

By entering the Contest, each entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the Contest and accepting a Prize, the winner or Minor winner’s parent or legal guardian hereby consents to the reasonable use by Contest Sponsors of the winner's name, age, photograph, voice, likeness and image, city and province/territory of residence, worldwide and in perpetuity, without any further compensation, for any future promotional activity in connection with this Contest. 

By entering the Contest, each entrant agrees that the Releasees shall bear no responsibility whatsoever with regard to any claims, liability, damage, injury, accident, loss and misfortune related to any aspects of the Contest, the Prize, the acceptance, use, misuse, possession and delivery of the Prize, participation of winner and his/her guests in any Prize related activities, printing errors, claims based upon publicity rights, defamation or invasion of privacy. By consenting to a Minor entrant’s entry into the Contest, the Minor entrant’s parent/legal guardian agrees to the foregoing on the Minor entrant’s behalf.

By entering the Contest and voluntarily providing personal information, each entrant (or the parent or legal guardian of a Minor entrant) consents and agrees to Contest Sponsors’ collection and use of the information provided by the entrant for the purpose of administering this Contest and, if consent is given at the time of entry, to provide the entrant with marketing information relating to new and existing products and upcoming promotions of Contest Sponsors by mail or email in accordance with your opt-in consent. Your personal information will not be disclosed to any third party nor will you receive communications from the Contest Sponsors unless your opt-in consent is received, in compliance with the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and its associated regulations, Canada’s Anti-Spam Law (“CASL”) and its associated regulations, and other applicable data protection and personal information protection laws. Contest Sponsors are not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrants’ inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules. 

Contest Sponsors reserve the right, in their sole and absolute discretion, and with the consent of the RACJ, to cancel, modify or suspend a contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.  Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way.  Appropriate notice to the RACJ will be provided where necessary.  Family Jr. and its sponsors are not responsible for preemption, cancellation, or interruption, in whole or in part, of any Family Jr. contest related programming.

For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.
