The Little Tikes® Big Play Giveaway Contest
FAMILY JR’S“Little Tikes, Big Play Giveaway” CONTEST (the “Contest”)
OFFICIAL RULES (the “Contest Rules”)
The Contest runs from 10:00 a.m. Eastern Time (“ET”) March 30, 2018 to 11:59 p.m. ET May 27, 2018 (the “Contest Period”).
HOW TO ENTER
NO PURCHASE NECESSARY.
To enter the Contest go to: (i) www.familyjr.ca, and click on the “Little Tikes, Big Play Giveaway " icon displayed in the “CONTESTS” section of the website to access the Contest microsite; or (ii) www.télémagino.ca and click on the "Concours Little Tikes – On Joue en grand" icon displayed in the “PARENTS” section of the website, to access the Contest microsite (www.familyjr.ca and www.télémagino.ca, are collectively and individually referred to as, the “Website(s)”)
Click the ENTER button to access the standard Contest entry form.Fill out the entry form by entering your full name, age, city, province or territory, phone number, email address and parent or legal guardian’s full name and contact information if you are a Minor entrant (as defined in Eligibility), then submit your completed entry form. A completed online entry form will constitute one entry into the Contest.
The only method of entry for this Contest is online entry (internet access required). Online entry is available through the Websites only; no other means of submission will be accepted. Although online access and an email account are required in order to participate, no purchase is required in order to enter the Contest. Many public libraries, retail businesses and others offer free access to computers and a number of Internet service providers and other companies offer free email accounts.
All eligible Contest entries will be entered for a chance to win the Grand Prize.
The Contest is open only to legal residents of Canada who are at least 16 years of age, excluding: (i) any person, or any person whose immediate family members (i.e., parents, children, spouse, siblings, grandparents, the “steps” of each and persons residing in such immediate family members' household), and persons with whom they are domiciled, has been declared a winner of another contest sponsored by DHX Television Ltd. (hereinafter referred to as “Family Jr.”, “Télémagino”, or the “Contest Sponsor”) within 90 days of the start of the Contest Period; (ii) employees, officers, directors, representatives, and agents (and their immediate family members or persons with whom they are domiciled, whether related or not) of the Contest Sponsor, and each of MGA Entertainment, Inc. (MGA Entertainment Inc. is the “Prize Provider”) and Toys “R” Us (Canada) Ltd. (“TRU” is the appointed designee of Prize Provider for Prize delivery), and each of their parents, subsidiaries and affiliates, and advertising and promotional agencies involved in this Contest. This Contest is subject to all federal, provincial, and municipal laws and regulations. Void where prohibited by law. Contest Sponsor with the consent of the Régie des alcools, des courses et des jeux (the “RACJ”) reserves the right to cancel or suspend this Contest in the event of any accident, or administrative or other error of any kind.
An entrant under the age of majority in his/her province of residence (a “Minor”) must have a parent or legal guardian consent to his/her participation. Minor entrant’s parent or legal guardian must provide his/her consent and his/her email address on the entry form, or the entry form will be disqualified. Proof of identification and parental consent must be provided upon request. If a parent or legal guardian does not provide consent, or if satisfactory proof of identification to confirm the winner’s (or the Minor winner’s parent or legal guardian’s) identity and personal information provided in connection with the Contest, including but not limited to, the winner’s (or the Minor winner’s parent or legal guardian’s) name and email address, cannot be obtained, the entry will be disqualified.
Entries must be received no later than 11:59 p.m. ET on May 27, 2018. Contest Sponsor takes no responsibility for entries that are lost, misdirected, delayed, garbled, incorrect, illegible or received after the Contest Period.
Limit one entry per person per day, in addition to a limit of four regular entries in the same household per day, regardless of which Website the entry is are submitted on. Only one email address and account may be used by any person to enter the Contest. In the event that Contest Sponsor receives more than the permitted number of entries, Contest Sponsor reserves the right to void and destroy any entries from that entrant and household, and that entrant/household may, at the discretion of the Contest Sponsor, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. Contest Sponsor reserves the right to disqualify all such entrants from future contests conducted by the Contest Sponsor without further notice.
In the event of a dispute as to the identity of a winner based on an email address, the winning entry will be deemed to be made by the authorized account holder of the email address at the time of entry. The authorized account holder is the natural person who is assigned an email address by an Internet service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question.
(referred to herein as “Prize(s)” or “Grand Prize(s)” as applicable)
There is one Grand Prize available to be won, consisting of:
- One Little Tikes® toy assortment package. The winner may select up to a maximum of C$4,000.00 worth of Little Tikes® toys of their choice, from a list provided to them by the Prize Provider (no gift cards, cash, or substitutions will be provided).
Approximate retail value of the Grand Prize is $4,000.00. All amounts are in Canadian dollars.
A random draw will be held at 12:00 p.m. ET on May 30, 2018, at the Contest Sponsor’s office located at 207 Queens Quay West, Suite 550, Toronto, Ontario. There will be one Grand Prize draw to fulfill this Contest. The chances of being selected to win the Grand Prize in this Contest depend on the total number of eligible entries received during the Contest Period, from amongst both Websites.
ACCEPTANCE OF PRIZE
A Contest Sponsor representative will notify the selected entrant, or the parent or legal guardian of the selected entrant who is a Minor, by telephone or email within ten days of the draw. The entrant will then have within ten days following receipt of notification to contact the Contest Sponsor and provide requested documentation to claim his/her Prize. Notification shall be deemed to have occurred, in the case of telephone notification, on the date that selected entrant, or in the case of a Minor, his or her parent or legal guardian, speaks with a representative of Contest Sponsor, or, in the case of email notification, the date the email is sent to the selected entrant’s email address by Contest Sponsor. It is the responsibility of the selected entrant or the selected Minor entrant’s parent or legal guardian to check his or her email account in a timely manner. Prior to being awarded the Prize, the entrant selected as the winner must correctly complete, unaided, a time-limited, mathematical, skill testing question and must sign a declaration and release form (the “Declaration and Release”) confirming compliance with these Contest Rules, his/her acceptance of the Prize as awarded; and acknowledging the non-responsibility of the Contest Sponsor, Prize Provider, and TRU, and each of their parents, affiliates, subsidiaries, cable and satellite affiliates, associates, their respective promotional and advertising agencies, and each of their respective employees, officers, directors, agents, successors and assigns (the “Releasees”), with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the Contest, any Prize awarded, the acceptance, use, misuse, possession and delivery of a Prize, participation of winner in any Prize related activities, printing errors or claims based upon publicity rights, defamation or invasion of privacy. A Minor winner’s parent or legal guardian must sign the Declaration and Release on his/her behalf in order for the winner to claim his/her Prize.
The Declaration and Release must be signed and returned by June 19, 2018. Should the Contest Sponsor be unable to contact the selected entrant by telephone or email, or should a selected entrantbe unable to correctly answer the skill-testing question or does not respond and complete the Declaration and Release by the deadline specified above, that selected entrant will be deemed to have forfeited any rights to the Prize and an alternate entrant will be selected in the same manner by random draw taken from the same pool of entries, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry. This process shall be repeated until such time as a selected entrant is confirmed to be the Prize winner or until there are no more eligible entries, but in any event no later than July 31, 2018. All Prize taxes, if any, are the responsibility of the winner.
Prize Provider or TRU shall deliver the Grand Prize to selected winner. Prize Provider, TRU and Contest Sponsor shall not be held responsible for the loss of any Prize due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or email address.
By submitting an entry, each entrant (or Minor entrant’s parent or legal guardian on his/her behalf) agrees to be bound by these Contest Rules.
All entries become the property of the Contest Sponsor and will not be returned.
Each Prize must be accepted “as is” and may not be exactly as shown. Contest Sponsor and Prize Provider, in their sole discretion, reserves the right to substitute any portion of a Prize with a prize of equivalent or greater retail value. Some restrictions may apply. Prizes are non-transferable, non-refundable, non-negotiable and have no cash value. If the actual value of any Prize is less than the stated approximate retail value, the difference will not be awarded. All Prize elements are subject to availability.
All incidental costs and expenses, including but not limited to, batteries and additional accessories, (the “Expenses”) not specifically mentioned herein as part of the Prize description are the sole responsibility of the Prize winner. The Prize winner shall not seek reimbursement for the Expenses from the Contest Sponsor, Prize Provider, or TRU.
Except where prohibited by law, Contest Sponsor and Prize Provider do not make any representation nor offer any warranty, express or implied, as to the quality or fitness of the Prize(s) awarded in connection with the Contest. Each Prize winner (or parent or legal guardian of a Minor winner) understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from the Contest Sponsor, Prize Provider, or TRU should the Prize fail to be fit for any purpose or is in any way unsatisfactory to a Prize winner.
By entering the Contest, each entrant agrees to waive all rights with respect to print and broadcast publicity. By entering the Contest and accepting a Prize, the winner or Minor winner’s parent or legal guardian hereby consents to the reasonable use by Contest Sponsor of the winner's name, age, photograph, voice, likeness and image, city and province/territory of residence, worldwide and in perpetuity, without any further compensation, for any future promotional activity in connection with this Contest.
By entering the Contest, each entrant agrees that the Releasees shall bear no responsibility whatsoever with regard to any claims, liability, damage, injury, accident, loss and misfortune related to any aspects of the Contest, the Prize, the acceptance, use, misuse, possession and delivery of the Prize, participation of winner in any Prize related activities, printing errors, claims based upon publicity rights, defamation or invasion of privacy. By consenting to a Minor entrant’s entry into the Contest, the Minor entrant’s parent or legal guardian agrees to the foregoing on the Minor entrant’s behalf.
Contest Sponsor is not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrants’ inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules.
Contest Sponsor reserves the right, in its sole and absolute discretion, and with the consent of the RACJ, to cancel, modify or suspend a contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way. Appropriate notice to the RACJ will be provided where necessary. The Contest Sponsor and its sponsors are not responsible for preemption, cancellation, or interruption, in whole or in part, of any Family Jr. and Télémagino contest related programming.
For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement.
